Information collected by the site - Cimdu pasakas - will not be shared with third parties, except to comply with any legal requirements to which Cimdu pasakas may be subject.

 

Any information collected will only be used for internal purposes, for the delivery of purchased digital files by email, and post delivery of purchased knitting-kits, or for responding to customer service queries. 

 

The only information that is collected in the course of digital files and knitting kit sale is the purchaser’s name, email address, shipping address and details of which charts have been purchased.

Payments

Payments are processed through PayPal. If you do not have a PayPal account, you do not need to sign up for one and you can still pay with a credit or debit card Visa, MasterCard, American Express or Discover

 

 

Downloads 

All Cimdu pasakas digital files are available for direct download from the Cimdu pasakas Store after purchase.

 

After you have successfully completed your payment, an email will be sent to your address containing a download link for the digital files

 

Should you lose the link to the download page or should you have any difficulty downloading the file, please immediately e mail quoting your PayPal Transaction ID or your credit / debit card Transaction with email address and the digital files will be emailed to you.

 

The digital files are provided in pdf format and can be read and printed with a suitable pdf reader such as Adobe Reader, which can be downloaded for free 

 

Downloaded Files include: full color pattern itself and general  instructions of the process. All pages will print at good quality on any desktop printer.

  

 

Legal & Copyright

 All the material on this Website, including the patterns and tutorials, is owned by  Cimdu pasakas and are subject to copyright under Latvian law, where copyright arises spontaneously on the creation of an original work and there is no registration requirement.

All Cimdu pasakas digital files are also subject to copyright protection in all other countries worldwide where it is available, including specifically the United States, the United Kingdom and the Russian federation (where no registration or other action in the Copyright Office is required to secure copyright). In most countries, copyright is secured automatically when an original work is created in a fixed form.

  

No part of the information provided, whether it be pattern PDFs, photos or text, any part of the pattern content, may be distributed without the permission of the copyright holder, Cimdu pasakas That is why you are asked to link to the pages on this website rather than distribute the PDFs yourself.

 

Jelena Čekina owns the copyright to all Cimdu pasakas digital files and knitting kits which are produced by Cimdu Pasakas

 

By purchasing digital files from Cimdu pasakas you are granted a limited license to download the related pdf file,  and to print a hard copy of each pattern, solely for your personal and non-commercial use.  You may not email the pattern or otherwise share it with anyone else.  Any other use, including commercial reproduction, modification, using digital files in any way as the basis for another distribution, transmission or republication by electronic or any other means without prior written permission from Cimdu pasakas, is strictly prohibited and is a violation of copyright and intellectual property rights. You are not permitted to produce items created from these patterns for commercial purposes or for sale, without prior written permission from Cimdu pasakas

 

Cimdu pasakas digital files and knitting kits are only sold through this website and are not available for wholesale, retail or resale by third parties without prior written permission. Cimdu pasakas does not offer volume discounts. Details of any special offers are always listed on the shopping page.

 

Cimdu pasakas patterns may not be included in any other knitting kits, but only purchased on the site

 

 

Licensing:

Licensing refers to how copyrighted material is used. For your convenience, I have broken this down into the following sections.

 

For non-profit:

The purchased Knitting Kit supposes one item for non-profit use. This means that you may only charge to cover material costs, and your labour will be given for free. This license agreement covers charity purposes and making gifts for friends and/or family. If you are donating the item, or giving the item to friends and/or family, credit must be given  with details of this website, should anyone else be interested in the origins of the designs and patterns. The designer, Cimdu pasakas should be informed and be able to contact direct by e-mail or phone with the person or organization which receive the donation or a gift. The ready-made item should contain the label with the name of both the designer and the knitter.

 

For profit:

Each item produced for profit should be provided by 5%  allocation to the designer, Cimdu pasakasThe calculation should be kept due to the percentage out of the knitting kit price on the website. Any mass production and manufacture without my knowledge is permitted. Should you wish to knit or manufacture large quantities from my designs, then please contact me.

 

Credit must be given to the designer, Cimdu pasakas, where possible with details of this website's URL, preferably on a tag. If the item is to be sold online, the designer's name MUST  be evident to avoid any speculation and makes things easier for everyone.

 

Where possible, you should charge a reasonable amount for your labour. Many knitters grossly undercharge for their labour when selling their hand-made goods, and this only serves the undervaluing of our crafts. The only way to change this perception is to charge a reasonable amount for our labour, and the labour charge should be greater than the cost of materials, and ideally be minimum wage or above.

 

Teaching classes based on my patterns and master-classes:

Teaching classes is permitted provided full credit is given to the designer, Cimdu pasakas, for the work.. Photocopying of my patterns is not permitted.

 

 

Cancellations & Refunds:

The following conditions are included to ensure that  Cimdu pasakas is compliant with the EU Consumer Rights Directive:

 

 

Right to Cancel

By clicking on the PayPal Pay Now button to complete your Cimdu pasakas  purchase, you explicitly acknowledge and agree

(i) that you will lose your right to cancel the digital files purchase contract after performance of the supply of digital content not supplied on a tangible medium (i.e. the delivery of the digital files pdf which you have purchased) has begun, 

(ii) that such performance begins when you click on the pattern download

 

If the payment is not made in 48 hours period the order is automatically canceled and the archives are not kept. So you need to place the order from the start.

 

For the avoidance of doubt, please note that Cimdu pasakas digital files purchases cannot be cancelled after you have clicked on the digital files download link or after they have been sent to you as email attachments.

 

 

Refunds/Returns

Digital files purchased from Cimdu pasakas which have been downloaded or sent to you as email attachments are non-refundable. Cimdu pasakas does not accept returns of digital files which have been downloaded or sent to you as email attachments.

 

 

EU VAT

Cimdu pasakas knitting-kits and  digital files prices shown on this website are inclusive of VAT. This applies to cross-border sales to purchasers resident in the EU. In accordance with the EU place of supply rules, with effect from 1 January 2015, VAT is chargeable on Services at the rate applicable in the EU member state where the purchaser resides.
